why a trademark search should be your first step

It is tempting to file an application as soon as you have a name you love. But a proper trademark search comes first — and it can save you from months of delay, an objection, or a full rebrand.

What a search uncovers

A thorough search looks for marks that are identical or deceptively similar to yours in the relevant class. "Similar" is broader than people expect: it includes names that sound alike, look alike, or carry the same meaning. The Registry — and the courts — consider the overall impression on an average consumer.

Why it saves money

Government filing fees are non-refundable. If your mark clashes with an existing one, your application is likely to be objected to or opposed, and the fee — plus the time — is lost. Worse, if you have already invested in packaging, signage and marketing, a later conflict can force an expensive rebrand.

Search is not a guarantee

Even a clean search does not guarantee registration. The examiner has discretion, unregistered prior users may surface, and oppositions can still arise. But a good search dramatically improves your odds and lets you make an informed decision.
