Well-Known Trademarks in India: Protection Beyond Your Class

Most trademarks are protected only for the goods or services they are registered for. But a special category, well-known trademarks, enjoys far wider protection. Under the Trade Marks Act, 1999, a well-known mark is protected even against use on unrelated goods and services where that use would take unfair advantage of, or harm, the mark’s reputation.

What makes a mark “well-known”

The Registry and courts look at factors set out in Section 11(6): how widely the public knows the mark, the duration and extent of its use and promotion, the geographical reach, and any record of successful enforcement. A mark known to a substantial segment of the relevant public can qualify.

Why it matters

  • Protection extends across classes, not just your registered ones.
  • It is a powerful basis to block copycats riding on your goodwill.
  • It strengthens opposition and infringement actions.

How to get there

You can build evidence of reputation over time, or apply to have a mark determined as well-known by the Registrar through a dedicated request supported by extensive evidence of use, advertising spend, sales, and public recognition. The bar is high and the evidence burden is significant.

Well-known status is the exception, not the norm. For most businesses, the priority is a solid registration in the right classes, reputation that may one day support well-known status is built on top of that.
