what is a trademark? types, benefits, and why it matters

A trademark is any sign that distinguishes the goods or services of one business from those of another. It can be a word, a logo, a name, a slogan, a shape, a combination of colours, or even a sound. In everyday terms, it is what your customers recognise you by — and protecting it stops others from trading on the goodwill you have built.

Why a trademark matters

Your brand name is often your most valuable asset. Without registration, you rely only on unregistered "common law" rights, which are harder and more expensive to enforce. A registered trademark gives you:

  • Exclusive rights to use the mark for the goods or services it covers.
  • A legal basis to act against copycats and infringers.
  • An asset you can license, sell, or franchise.
  • Nationwide protection across India once registered.

Common types of trademarks

The most common categories you will encounter are:

  • Word marks — protecting the name itself, in any font or style.
  • Logo / device marks — protecting a specific visual design.
  • Composite marks — a name and logo together.
  • Slogans — distinctive taglines.
  • Non-conventional marks — sounds, shapes, or colour combinations.

What makes a strong trademark?

Distinctiveness is everything. Invented words (think coined names) and arbitrary names are the strongest. Descriptive words — ones that simply describe the product — are weak and often objected to, because no single trader should monopolise ordinary language. The more unique your mark, the smoother its path through registration.

Tip: before falling in love with a name, run a trademark search. It is far cheaper to change a name early than to rebrand after an objection or dispute.
